Analisis Kebijakan SPBE (Sistem Pemerintahan Berbasis Elektronik) dalam Perspektif Administrasi dan Hukum Administrasi Negara

The development of information technology has encouraged governments around the world to transform their bureaucratic systems toward a digital government model. In Indonesia, one of the strategic initiatives undertaken is the implementation of the Electronic-Based Government System (Sistem Pemerintahan Berbasis Elektronik/SPBE) as regulated under Presidential Regulation Number 95 of 2018. This policy aims to improve effectiveness, efficiency, integration, transparency, and accountability in public administration and public service delivery. However, the implementation of SPBE continues to face various challenges, including infrastructure readiness, civil servant competencies, inter-agency coordination, as well as issues related to legality, data protection, and legal accountability. Therefore, a comprehensive analysis of the SPBE policy is necessary, not only from the perspective of Public Administration but also from the perspective of Administrative Law. This study aims to: (1) analyze the implementation of SPBE policy within the context of Public Administration; (2) examine the legal foundations and application of Administrative Law principles in the implementation of SPBE; and (3) comprehensively analyze SPBE policy from the perspectives of both Public Administration and Administrative Law. The study is theoretically grounded in classical bureaucracy theory, New Public Management, governance theory, and digital bureaucracy concepts, as well as principles of Administrative Law, including legality, the General Principles of Good Governance (AUPB), administrative discretion, personal data protection, and legal accountability. The research employs a qualitative method with a library research approach. Data are collected from laws and regulations, official government policy documents, SPBE evaluation reports, academic books, national and international journals, and previous studies. Data analysis is conducted through descriptive analysis, content analysis, and comparative-conceptual analysis to critically and integratively connect theoretical perspectives with policy implementation.This research is expected to contribute theoretically to strengthening the study of Public Administration and Administrative Law in the context of digital bureaucratic transformation. Practically, the findings are expected to serve as a reference for the formulation and improvement of SPBE policies to ensure greater effectiveness, legality, accountability, and public service orientation. The output of this research is planned to be published in an accredited national journal to generate broader academic and practical impacts
