Abstract

The development of the broadcasting media industry has positioned infotainment programs as part of modern journalistic practice. However, the legal status of infotainment journalists and the legal protection afforded to infotainment press workers remain uncertain due to the absence of explicit legal regulations. This study aims to analyze legal certainty regarding the legal status of infotainment journalists and the legal protection of infotainment press workers within Indonesia’s press legal system. This research employs a normative legal research method using statutory, conceptual, and case approaches, analyzed through Gustav Radbruch’s Theory of Legal Certainty and Philipus M. Hadjon’s Theory of Legal Protection. The findings indicate that infotainment journalists substantively fulfill the elements of journalistic activities and therefore qualify as journalists. Nevertheless, they have not yet obtained legal certainty due to the existence of vague legal norms. Furthermore, legal protection for infotainment press workers remains inadequate because of the unclear employment status, which affects the fulfillment of their statutory employment rights. This study concludes that explicit legal regulation concerning the status of infotainment journalists and certainty regarding their employment status is necessary. It further recommends harmonizing press law, employment law, and broadcasting law, as well as establishing clear legal provisions to ensure comprehensive legal protection for infotainment press workers.
