Abstract

Teknologi informasi telah mengubah layanan kesehatan, terutama melalui telemedisin, yang memungkinkan akses lintas batas. Namun, pertumbuhan ini belum diiringi dengan harmonisasi kerangka hukum yang komprehensif, sehingga menimbulkan celah dalam perlindungan pasien. Penelitian ini membahas dua pertanyaan utama: bagaimana kerangka hukum nasional Indonesia dapat diselaraskan dengan standar internasional untuk melindungi pasien dalam telemedisin lintas batas, dan mekanisme penegakan hukum serta akses ke keadilan apa saja yang tersedia secara efektif ketika terjadi pelanggaran? Dengan menggunakan pendekatan analitis normatif dan studi komparatif, penelitian ini mengungkap adanya celah regulasi yang signifikan di Indonesia terkait perizinan praktisi asing, standar pertanggungjawaban medis, dan mekanisme penyelesaian sengketa. Rekomendasi yang diajukan meliputi pembentukan perjanjian pengakuan timbal balik bilateral, penyatuan standar etika, serta pengembangan platform penyelesaian sengketa daring untuk meningkatkan akses pasien terhadap keadilan.
