Abstract

Sexual violence represents one of the gravest offenses against human dignity, imposing severe psychological, bodily, and societal repercussions on victims. Within Indonesia, incidents of sexual violence have exhibited a persistent upward trajectory annually, although prior legal frameworks have been deemed insufficient in affording adequate safeguards for those affected. The Criminal Code (KUHP), inherited from the colonial period, confines its provisions to rape and indecent assault in a highly restricted manner, thereby excluding myriad manifestations of sexual violence from penal sanctions. Such normative deficiencies necessitated the promulgation of Law No. 12 of 2022 concerning Sexual Violence Offenses (UU TPKS) as a dedicated statute designed to address legislative lacunae and bolster comprehensive victim protections. This research seeks to scrutinize the mechanisms of legal safeguards extended to sexual violence victims pursuant to UU TPKS, alongside evaluating the degree to which said regulation delivers juridical predictability and equity for victims in the framework of Indonesia's material criminal law. Normative juridical inquiry is adopted herein, incorporating statutory analysis and case-based examination. Primary legal materials encompass pertinent statutes and judicial rulings, whereas secondary materials include academic publications, peer-reviewed journals, and doctrinal expositions relevant to the research theme. The outcomes of this investigation reveal that UU TPKS heralds substantial advancements in the architecture of juridical safeguards for sexual violence victims. Key innovations encompass broadening the conceptualization and ambit of sexual violence offenses to encompass nine distinct categories, formal acknowledgment of victims' entitlements, institutionalization of support and rehabilitation protocols for victims, and fortification of victim-oriented procedural norms. Nonetheless, implementation encounters multiple obstacles, notably the alignment of provisions between UU TPKS and the revised Criminal Code (Law No. 1 of 2023), coupled with the preparedness of enforcement agencies to enforce the novel statute uniformly.
