Penolakan Pemerintah Taliban Terhadap Norma Global Hak Pendidikan Perempuan di Afghanistan pada Periode 2021-2025

Abstract

Sejak Taliban berhasil memegang kendali pemerintahan Afghanistan, banyak sekali isu-isu yang terjadi, khususnya pelanggaran hak pendidikan terhadap perempuan. Afghanistan sebagai negara peratifikasi berbagai konvensi seperti Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) dan Convention on the Rights of the Child (CRC), tetapi secara praktiknya di bawah pemerintahan Taliban melakukan hal yang berkebalikan dengan prinsip yang ada di kedua konvensi tersebut. Dengan menggunakan konsep norm subsidiarity dari Acharya, tulisan ini akan menganalisis pemerintah Taliban dalam menavigasi hak pendidikan perempuan di Afghanistan melalui penolakan norma global. Metode yang digunakan adalah analisis kualitatif. Tulisan ini akan menggunakan data-data terkait pelanggaran hak pendidikan perempuan di Afghanistan yang akan diambil melalui website, laporan, perjanjian internasional, artikel, portal berita, dan buku. Pertanyaan utama penelitian ini adalah bagaimana pemerintah Taliban menavigasi hak pendidikan perempuan di Afghanistan melalui penolakan norma global pada periode 2021 – 2025. Berdasarkan konsep norm subsidiarity, hipotesis yang bisa diambil adalah bahwa norma global di Asia tidak selalu berjalan lurus, tetapi juga dinamis dengan mengalami penolakan dan pembentukan norma tandingan di tingkat domestik. Local agents juga memiliki kapasitas untuk menafsirkan dan menolak norma sesuai dengan konteks budaya dan ideologi local agents tersebut.
