Abstract

UNHCR memiliki peran dalam menjamin hak asasi para pengungsi di setiap wilayah. Terkhusus kedatngan para pengungsi Rohingya ke Indonesia dan menjadikan Indonesia sebagai negara transit sebelum datang ke negara destinasi atau negara ketiga. Berfokus di Sumatera Utara pada periode 2020–2025, walaupun Indonesia belum meratifikasi Konvensi 1951 maupun Protokol 1967, UNHCR tetap aktif memberikan perlindungan kemanusiaan serta mengadvokasi hak-hak pengungsi, termasuk akses pendidikan bagi anak-anak. Dukungan pemerintah Indonesia terlihat melalui instrumen hukum seperti Undang-Undang No. 39 Tahun 1999 tentang HAM dan Peraturan Presiden No. 125 Tahun 2016, yang memfasilitasi pemenuhan kebutuhan dasar pengungsi. Kendati demikian, hambatan masih muncul akibat ketiadaan mekanisme resmi penentuan status pengungsi dan keterbatasan sumber daya. Studi ini menekankan kontribusi UNHCR dalam menutup celah tersebut dengan berkoordinasi bersama otoritas lokal dan masyarakat sipil melalui pendekatan tata kelola kemanusiaan internasional (international humanitarian governance). Temuan ini menegaskan urgensi peningkatan kolaborasi serta reformasi kebijakan demi menjamin perlindungan yang berkelanjutan dan adil bagi pengungsi Rohingya di kawasan tersebut.
