Abstract

Penelitian ini mengkaji peran advokat dalam memberikan perlindungan hukum terhadap korban kekerasan dalam rumah tangga (KDRT) di LKBH Yayasan Pesantren Nurul Islam Banyuwangi dalam perspektif hak asasi manusia (HAM) dan maqāṣid al-sharī‘ah Jasser Auda. Penelitian ini menggunakan penelitian hukum empiris dengan pendekatan kualitatif. Data dikumpulkan melalui observasi, wawancara, dan dokumentasi yang melibatkan praktisi hukum terkait serta partisipan penelitian di LKBH. Hasil penelitian menunjukkan bahwa perlindungan hukum dimulai melalui konsultasi hukum, edukasi, dan penjelasan mengenai konsekuensi hukum dari KDRT, yang kemudian dilanjutkan dengan pendampingan hukum sesuai dengan kondisi dan pilihan hukum korban. Pendampingan diberikan melalui mekanisme nonlitigasi, termasuk konsultasi dan edukasi hukum, serta mekanisme litigasi, khususnya proses perceraian dan proses pidana seperti pelaporan kepada kepolisian serta pendampingan selama proses penyidikan dan penuntutan. Dalam perspektif HAM, praktik tersebut mendukung perlindungan terhadap martabat, keamanan, hak-hak, dan akses korban terhadap keadilan. Melalui pendekatan sistem Jasser Auda, temuan tersebut dapat dipahami melalui enam fitur, yaitu sifat kognitif (cognitive nature), keutuhan (wholeness), keterbukaan (openness), hierarki yang saling berkaitan (interrelated hierarchy), multidimensionalitas (multidimensionality), dan kebermaksudan (purposefulness). Penelitian ini menyimpulkan bahwa advokasi hukum menghubungkan bantuan hukum prosedural dengan perlindungan substantif dengan menempatkan martabat, pencegahan kemudaratan, keadilan, dan tujuan hukum yang lebih luas sebagai dasar pendampingan.
